Produce The Note!
Ok, so you are now facing foreclosure and you may even have a foreclosure sale date on your home…what can you do now to try and stop foreclosure? There is a strategy called “Produce The Note” that can force a lender to come up the the actual note you signed on your property. The reason for this is when the banks were doing all the mortgage writing and buying and selling paper, they failed to follow procedure and obtain the note from the lender who sold them the paper. This will allow you to stall the foreclosure or maybe even negotiate with the for a better mortgage deal…they have to PROVE they have the note!
